1. Introduction & Acceptance of Terms
These Terms of Service (“Terms”) govern the access to, and use of, the website www.nowayer.co (the “Website”), and the purchase of products offered by Nowayer Trading, a business registered and operating under the laws of the State of Qatar (“Nowayer,” “we,” “our,” or “us”).
By accessing, browsing, or using the Website, and by placing an order for any product offered by Nowayer, you (“you,” “your,” or the “Customer”) acknowledge and agree that you are entering into a binding legal agreement with Nowayer Trading, subject to these Terms.
By accessing the Website or completing a purchase, you further confirm that you are of legal age in your country of residence, or that you have obtained the consent of your legal guardian to use this Website and to authorize any of your dependents to do the same.
If you do not agree with these Terms in their entirety, you must not access or use the Website, nor purchase products from Nowayer.
Your use of this Website is also subject to additional policies, including our Privacy Policy, Shipping Policy, Refund Policy, and Color Accuracy Disclaimer (together, the “Policies”). These Policies are incorporated by reference into these Terms and carry the same legal force and effect.

Nowayer conducts business primarily from Qatar but offers products to customers across the Gulf Cooperation Council (GCC) region and internationally.
These Terms, and any dispute, controversy, or claim arising out of or in connection with them, are governed by and construed in accordance with the laws of the State of Qatar, without regard to conflict of law provisions. International conventions or foreign consumer laws may apply only where mandatory and only to the extent that such provisions cannot legally be waived under Qatari law.
Please note that all return and refund requests remain subject to Nowayer’s inspection and approval. Acceptance or rejection of any return request shall be at the sole discretion of Nowayer, after careful review of the product’s condition.
3. Eligibility to Use the Website
By using the Website and purchasing products, you represent and warrant that:
● You are at least 18 years of age or the age of legal majority in your country of residence, whichever is higher.
● You have the legal capacity to enter into binding contracts.
● If you are accessing the Website on behalf of a business entity, you have authority to bind that entity to these Terms.
Nowayer does not knowingly collect or process orders from individuals under the age of 18. By placing an order, you confirm compliance with this requirement.
Customers are solely responsible for ensuring that access to, and use of, the Website and the purchase of products comply with the laws and regulations of their jurisdiction. Nowayer disclaims all responsibility and liability for any use of the Website or its products in violation of applicable laws outside the State of Qatar.
4. Account Registration & Security
Certain features of the Website may require registration and the creation of a customer account. When registering, you must provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account.
You agree to:
● Immediately notify Nowayer of any unauthorized use of your account or security breach.
● Ensure that you log out of your account at the end of each session.
● Accept full liability for all orders placed and actions taken through your account, whether authorized by you or not.
Nowayer reserves the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent or abusive activity.
5. Products & Services Description
Nowayer specializes in the sale of women’s fashion and lifestyle products, including but not limited to: abayas, caftans, headscarves, shirts, trousers, t-shirts, caps, brooches, necklaces, prayer beads, keychains, perfumes, oud, oud oil, incense burners, mugs, notebooks, and pens (the “Products”).
We strive to ensure that product descriptions, images, specifications, and pricing displayed on the Website are accurate and up to date. However, Nowayer does not warrant that such information is error-free, complete, or reliable. All descriptions and representations are provided for general information purposes only and shall not constitute a guarantee, warranty, or representation of product performance.
Minor variations in size, design, packaging, and presentation may occur, consistent with customary commercial practice. In particular, colors may appear differently due to lighting, photography, or screen settings; the Color Accuracy Disclaimer applies in full.
Nowayer reserves the right, at any time and without notice, to modify or discontinue any Product or feature, or to limit the quantities available for purchase.
Certain Products, including but not limited to abayas and caftans, may be available on a pre-order or custom-order basis. Customers purchasing such items expressly acknowledge and agree that:
● Pre-order and custom-made items are produced to the specifications and/or measurements provided by the Customer at the time of order.
● Due to the bespoke nature of these items, no cancellations, returns, or exchanges are permitted except where mandated by law or where the item is demonstrably defective due to Nowayer’s fault.
● Nowayer shall not be responsible for inaccuracies arising from incorrect measurements or specifications supplied by the Customer.
● Custom or pre-order requests cannot be modified after confirmation.
By placing a pre-order, you agree that production and delivery timelines are estimates only, and delays may occur due to production schedules, supply chain constraints, or customs clearance.
All prices for Products are displayed on the Website in Qatari Riyal (QAR) or in other currencies as may be supported on the Website. While Nowayer endeavors to ensure that pricing information is accurate, errors may occasionally occur. In such cases, Nowayer reserves the right to correct errors without liability, including after an order has been submitted.
We may update or adjust product prices from time to time without prior notice. We also reserve the right to modify, suspend, or discontinue the Website or any of its services, in whole or in part, whether temporarily or permanently, without prior notice.
Nowayer shall not be held liable to Customers or any third party for any price changes, service modifications, or the suspension or discontinuation of the Website.
Prices do not include shipping charges, customs duties, or taxes, which may be added at checkout or levied by authorities in the Customer’s jurisdiction. Customers are solely responsible for payment of all such additional costs.
For international orders, currency conversions, bank charges, and cross-border transaction fees are the sole responsibility of the Customer.
Nowayer reserves the right to adjust pricing at any time without prior notice. Such changes will not affect confirmed orders already accepted by Nowayer.
Nowayer accepts payment through the methods made available on the Website, which may include credit cards, debit cards, online payment gateways, or other approved payment processors. By submitting payment information, you represent and warrant that you are authorized to use the designated payment method and that the information you provide is true, accurate, and complete.
Payment is due in full at the time of order placement, unless otherwise expressly agreed in writing by Nowayer. Orders will not be processed or shipped until full payment has been successfully received and verified.
Nowayer reserves the right to:
● Refuse or cancel any order where payment is unauthorized, invalid, or refused by the payment provider.
● Suspend or terminate any transaction suspected of fraud, money laundering, or unauthorized activity.
● Require additional identity verification before accepting or fulfilling an order.
All payments are processed subject to the terms, conditions, and privacy policies of the relevant payment processors, for which Nowayer bears no responsibility or liability.
All transactions processed through Visa, Mastercard, and PayPal are also governed by the respective terms and conditions of those service providers, in addition to these Terms.
9. Order Acceptance & Confirmation
When you place an order on the Website, you are submitting an offer to purchase the selected Products under these Terms. Receipt of an order confirmation does not constitute acceptance of your order by Nowayer. Acceptance occurs only when Nowayer issues a written confirmation or dispatches the Products, whichever is earlier.
Nowayer reserves the right, at its sole discretion, to refuse or cancel any order for reasons including but not limited to:
● Product unavailability or discontinuation.
● Errors in product information or pricing.
● Suspected fraud, unauthorized transactions, or violations of these Terms.
If Nowayer cancels an order after payment has been received, a refund will be issued to the original payment method within a reasonable timeframe.
Products are shipped in accordance with Nowayer’s Shipping, Return and Refund Policy, which forms an integral part of these Terms. By placing an order, you acknowledge and agree to the terms contained therein.
Estimated delivery times are provided for convenience only and are not binding guarantees. Actual delivery may vary due to factors beyond Nowayer’s control, including but not limited to: courier delays, customs inspections, force majeure events, or logistical constraints.
Once the products have been handed over to the carrier, Nowayer shall not be liable for delays, loss, or non-delivery caused by the carrier, customs, or other force majeure events. In such cases, the Customer’s sole remedy shall be limited to following up directly with the carrier, and Nowayer’s responsibility shall be deemed fulfilled.
For international orders, you acknowledge and accept responsibility for compliance with import regulations, including the payment of any applicable duties, taxes, tariffs, or clearance fees imposed by authorities in the destination country.
Risk of loss transfers to the Customer upon delivery of the Products to the carrier. Title to the Products shall not pass to the Customer until full payment of the purchase price has been received and cleared by Nowayer.
11. Risk of Loss & Title Transfer
All sales are made on a shipment contract basis, unless expressly stated otherwise in writing. This means that the risk of loss or damage to Products passes to the Customer once Nowayer delivers the Products to the carrier.
Please note that Nowayer is not responsible once the product has been delivered to the shipping company.
Title to Products remains with Nowayer until full payment of the purchase price, including shipping fees, duties, and taxes, has been received. If payment is declined, reversed, or disputed, Nowayer retains the right to reclaim or demand return of the Products at the Customer’s expense.
12. Returns, Refunds & Exchanges
Returns and exchanges are governed by Nowayer’s Refund Policy, which forms part of these Terms. By purchasing Products, you agree to be bound by the terms of that policy.
In summary, and without limitation:
- Pre-order and custom-made items are final sale and not eligible for return, exchange, or cancellation except where defective due to Nowayer’s error.
- Ready-to-wear items may be eligible for return or exchange solely in cases of manufacturing defect or company error, provided that:
- The item is unused, in original condition, and returned with all tags and packaging.
- The defect is reported within seven (7) days of receipt.
- Accessories, perfumes, oud, oud oil, incense, and personal-use items are non-returnable, due to their special nature and for health and hygiene reasons.
Customers are required to report any defective or damaged items within 24 hours of receiving the order. Claims submitted after this period may not be accepted.
All return requests remain subject to Nowayer’s review, and acceptance or rejection of such requests shall be at the sole discretion of Nowayer after inspection of the returned product.
Refunds, where approved, will be made to the original payment method within a commercially reasonable period, subject to bank or payment processor timelines.
In general:
● Pre-orders and custom-made Products cannot be cancelled once confirmed.
● Ready-to-wear orders may only be cancelled prior to dispatch. Once an order has shipped, cancellation is no longer possible, and the return policy shall apply instead.
● Nowayer reserves the right to cancel any order, at its discretion, if the Product becomes unavailable, payment is not successfully processed, or fraudulent activity is suspected.
If Nowayer cancels an order, the Customer will be notified and, where applicable, a refund will be processed to the original payment method.
Nowayer makes every effort to display Products accurately on the Website. However, Customers acknowledge and accept that:
● Variations in color, texture, and appearance may occur due to differences in lighting, photography techniques, and screen display settings.
● Such variations do not constitute a defect, misrepresentation, or non-conformity.
● By purchasing Products, the Customer accepts the possibility of such differences and waives any claim or remedy based solely on color discrepancies.
This disclaimer applies to all Products, including but not limited to clothing, fabrics, accessories, and decorative items.
15. Intellectual Property Rights
All content on the Website, including but not limited to product designs, images, photographs, logos, text, graphics, video clips, software, and the arrangement thereof, is the exclusive property of Nowayer Trading or its licensors and is protected under applicable copyright, trademark, and intellectual property laws in Qatar and internationally.
You may not reproduce, distribute, modify, transmit, publicly display, perform, or create derivative works from any content without Nowayer’s prior written consent. Unauthorized use of any intellectual property may give rise to civil claims and criminal prosecution under Qatari law.
All trademarks, service marks, and trade names displayed on the Website are proprietary to Nowayer or their respective owners. No license or right is granted to you by implication, estoppel, or otherwise.
16. User Conduct & Prohibited Activities
Customers and visitors to the Website agree not to:
● Use the Website for unlawful, fraudulent, or harmful purposes.
● Interfere with the security or functionality of the Website.
● Attempt to gain unauthorized access to accounts, systems, or networks.
● Scrape, mine, or harvest data from the Website without express permission.
● Use the Website or Products for resale, commercial distribution, or export in violation of applicable laws.
Nowayer reserves the right to suspend or terminate access for any conduct deemed abusive, illegal, or in violation of these Terms.

Such links are provided for convenience only, and Nowayer does not endorse, monitor, or assume responsibility for the content, privacy practices, or terms of such third parties.

Your privacy is important to us. The collection, use, and disclosure of personal data are governed by Nowayer’s Privacy Policy, incorporated herein by reference.
By using the Website and purchasing Products, you consent to the processing of your personal data in accordance with the Privacy Policy and applicable laws of Qatar. Where international transfers of data occur, Customers acknowledge and accept that local privacy standards may differ.

The Website and all Products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Nowayer disclaims all warranties, express or implied, including but not limited to:
● Merchantability, fitness for a particular purpose, or non-infringement.
● Continuous, uninterrupted, or error-free operation of the Website.
● Exact conformity of Products with descriptions or images.
Customers acknowledge that use of the Website and purchase of Products are undertaken at their own risk.
To the fullest extent permitted by law, Nowayer shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with the use of the Website or the purchase of Products.
Nowayer’s total liability, whether in contract, tort, or otherwise, shall in no case exceed the amount actually paid by the Customer for the specific Product giving rise to the claim.
Certain jurisdictions do not allow exclusion or limitation of liability for consequential damages; in such cases, Nowayer’s liability shall be limited to the maximum extent permitted under Qatari law.
You agree to indemnify, defend, and hold harmless Nowayer Trading, its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of:
● Your breach of these Terms or any applicable law.
● Your misuse of the Website or Products.
● Any third-party claim arising from content you provide or actions you take through the Website.
Nowayer shall not be liable or deemed in default for failure to perform obligations where such failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, embargoes, government orders, pandemics, supply chain interruptions, or failures of internet, telecommunications, or transport infrastructure.
Performance shall be suspended for the duration of the force majeure event, and Nowayer may cancel affected orders without liability if such event materially prevents fulfillment. In such cases, the Customer’s right shall be limited strictly to a refund of the product value already paid, without any further compensation or damages.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, such provision shall be severed without affecting the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
These Terms, together with the referenced Policies, constitute the entire agreement between you and Nowayer with respect to the use of the Website and the purchase of Products. They supersede all prior or contemporaneous understandings, agreements, or representations, whether written or oral.
26. Amendments & Updates to Terms
Nowayer reserves the right to amend, update, or replace these Terms at any time, at its sole discretion. Updated Terms will be posted on the Website with a revised “Last Updated” date. Continued use of the Website following such updates constitutes acceptance of the revised Terms.
It is your responsibility to review the Terms periodically.
27. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Qatar. Any dispute, controversy, or claim arising out of or relating to these Terms, the Website, or the Products shall be subject to the exclusive jurisdiction of the competent courts of Doha, Qatar.
At Nowayer’s discretion, disputes may alternatively be referred to binding arbitration under the rules of the Qatar International Court and Dispute Resolution Centre (QICDRC), with proceedings conducted in English or Arabic. The arbitral award shall be final and binding.
