REFUND POLICY

1. Introduction

This Refund Policy (“Policy”) governs the terms under which customers (“you,” “your,” or the “Customer”) may seek a refund for products purchased through www.nowayer.co (the “Website”).

This Policy forms part of the contractual framework between you and Nowayer Trading (“Nowayer,” “we,” “our,” or “us”) and must be read in conjunction with our Terms of Service, Shipping Policy, and Privacy Policy (together, the “Policies”).


2. Eligibility for Refunds

Refunds will be granted strictly under the following conditions:

  • The product received is defective, damaged, or incorrect due to Nowayer’s error.
  • The Customer notifies Nowayer in writing within twenty-four (24) hours of receipt in the case of defective or damaged items.
  • The Customer initiates a return request within seven (7) days of delivery for eligible ready-to-wear items, subject to the conditions set out below.

3. Non-Refundable & Final Sale Items

The following categories of products are non-refundable and ineligible for return or exchange:

  • Pre-orders and custom-made items (including made-to-measure abayas and caftans), except where demonstrably defective due to Nowayer’s error.
  • Perfumes, oud, oud oil, and incense, due to their special nature and health/hygiene restrictions.
  • Accessories intended for personal use, including but not limited to jewelry and prayer beads.
  • Sale or clearance items, unless defective.

4. Conditions of Returned Products

For a refund request to be considered valid, the returned item must:

  • Be unused, unworn, and unwashed.
  • Be in its original condition, with all tags, labels, and packaging intact.
  • Be returned together with proof of purchase and order details.

Failure to meet these conditions may result in rejection of the refund request.


5. Company Discretion

All refund and return requests remain subject to Nowayer’s inspection and approval. Acceptance or rejection of any refund claim shall be at Nowayer’s sole discretion, after review of the product and the circumstances of the claim.


6. Refund Process

  • Refunds, once approved, will be issued exclusively to the original method of payment.
  • Refunds shall cover the product cost only and shall not include shipping fees, customs duties, taxes, or handling charges, unless otherwise required by law.
  • Refunds will be processed within a commercially reasonable timeframe, generally within seven (7) to twenty-one (21) business days, subject to bank or payment gateway processing times.
  • Where feasible, Nowayer may offer a replacement or exchange in lieu of a refund, at its sole discretion.

7. Payment Gateways

Transactions processed through Visa, Mastercard, or PayPal are additionally governed by the terms and conditions of those providers. Nowayer shall not be responsible for delays, fees, or restrictions imposed by third-party payment processors.


8. Cancellations

  • Orders for ready-to-wear products may only be cancelled prior to dispatch.
  • Pre-orders and custom-made products cannot be cancelled once confirmed.
  • Once dispatched, orders may not be cancelled. Customers must instead pursue a refund request where eligible under this Policy.

9. Force Majeure & Carrier Responsibility

We are not responsible for delays caused by customs, shipping companies, or circumstances beyond our control.
Nowayer assumes no responsibility once the product has been delivered to the shipping company.


10. Governing Law & Jurisdiction

This Policy shall be governed by, and construed in accordance with, the laws of the State of Qatar. Any dispute arising out of or in connection with this Policy shall fall within the exclusive jurisdiction of the courts of Doha, Qatar.
