SHIPPING POLICY

1. Introduction
This Shipping Policy (“Policy”) sets forth the terms and conditions governing the delivery of products purchased through www.nowayer.co (the “Website”). It is to be read together with Nowayer Trading’s Terms of Service, Refund Policy, and Privacy Policy (collectively, the “Policies”), each of which is legally binding.
By placing an order with Nowayer Trading (“Nowayer,” “we,” “our,” or “us”), you (“you,” “your,” or the “Customer”) acknowledge and agree to be bound by this Policy.
2. Shipping Regions
Nowayer ships to:
- Customers within the State of Qatar;
- Customers in all Gulf Cooperation Council (GCC) countries; and
- Customers worldwide, subject to courier availability and compliance with applicable customs and import regulations.
3. Shipping Fees
- Shipping fees are calculated at checkout and may vary depending on the destination, order value, and courier service selected.
- Nowayer may, at its discretion, offer free or discounted shipping promotions from time to time, which will be expressly indicated on the Website.
- For international shipments, the Customer is solely responsible for all customs duties, import taxes, VAT, and clearance charges imposed by the destination country’s authorities.
4. Processing & Delivery Times
- Unless otherwise specified (e.g., pre-orders), orders are generally processed within two (2) to five (5) business days following payment confirmation.
- Estimated delivery timelines:
- Within Qatar: one (1) to three (3) business days from dispatch.
- Within GCC: five (5) to ten (10) business days from dispatch.
- International: typically ten (10) or more business days, subject to customs clearance and courier performance.
- These timelines are estimates only and not binding guarantees. Delays may occur due to seasonal demand, courier disruptions, customs inspections, or force majeure events.
5. Risk of Loss & Title
All orders are fulfilled on a shipment contract basis.
- Risk of loss, theft, or damage passes to the Customer once the goods are delivered by Nowayer to the carrier.
- Title to the goods shall not transfer to the Customer until Nowayer has received full payment of the purchase price, including shipping charges, duties, and taxes.
6. Pre-Orders & Custom-Made Products
Certain products, including but not limited to abayas and caftans, may be produced on a pre-order or made-to-measure basis. Customers acknowledge that:
- Pre-order and custom-made items are final sale and not eligible for cancellation, return, or refund except where demonstrably defective as a result of Nowayer’s error.
- The Customer bears responsibility for the accuracy of measurements or specifications submitted at the time of order.
- Custom or pre-order requests cannot be modified after confirmation.
7. Order Cancellations
- Orders for ready-to-wear items may be cancelled only prior to dispatch.
- Pre-orders and custom-made items cannot be cancelled once confirmed.
- After dispatch, orders cannot be cancelled. Customers wishing to return an item (where eligible) must follow the Refund Policy.
8. International Customers
For orders outside Qatar:
- Customers are responsible for all customs duties, VAT, import taxes, and fees imposed by the destination country.
- Customers must ensure compliance with all applicable import restrictions and regulations.
- Nowayer disclaims liability for delay, seizure, or non-delivery arising from customs clearance or import compliance issues.
9. Carrier Liability & Force Majeure
Once products have been handed over to the carrier, Nowayer shall not be liable for delays, loss, or non-delivery caused by the carrier, customs, or other force majeure events. In such cases, the Customer’s sole remedy is to follow up directly with the carrier, and Nowayer’s responsibility is deemed fulfilled.
Force majeure events include but are not limited to strikes, labor disputes, natural disasters, acts of war or terrorism, epidemics or pandemics, governmental restrictions, customs delays, courier disruptions, or failures of transport infrastructure.
10. Governing Law & Jurisdiction
This Policy shall be governed by the laws of the State of Qatar. Any dispute arising under it shall be subject to the exclusive jurisdiction of the competent courts of Doha, Qatar.
